PHMSA Notices Preemption Petitions on Hazmat Permits, Fees in NYC and Pittsburgh

The Pipeline and Hazardous Materials Safety Administration has published notices requesting comments on petitions by the American Trucking Associations to preempt local permit and fee requirements on hazardous materials transportation by truck in New York City and Pittsburgh. The permits and fees are required to transport certain quantities of hazardous materials into or through the cities. ATA claims that the requirements are preempted by federal statute, which preempts state or local requirements under a "dual compliance" or "obstacle" standard as adopted by the U.S. Supreme Court.

Proposed GAWDA Health Plan
GAWDA is considering creating a group purchasing health plan opportunity for its membership businesses. This program would guarantee ACA compliance, provide added health and wellness resources, and collectively obtain health insurance options as a whole at less expensive and more long-term sustainable costs than individual businesses may find on their own. We are asking all members to provide us basic information to determine if this initiative has sufficient interest and support to pursue. Please complete the survey here.
