Final Rule Addresses Hours of Service

The Federal Motor Carrier Safety Administration has issued guidance that offers relief from one of the unintended consequences of the short-haul driver exemption from the 30-minute break requirement in the driver hours of service regulations. 78 Fed. Reg. 76757 (December 19, 2013). The guidance addresses the scenario where a CMV driver who is not subject to the log book or 30-minute break requirement might exceed 12 hours on duty, or drive outside the 100- or 150- air mile radius, and therefore must fill out a log book for that duty period; under the current rules, that driver has also violated the break requirement if s/he drove after 8 hours on duty without a 30-minute break. Severe Winter Weather Causes Business Delays, Including Propane "Drought"

Since mid-December, weather across the United States has been forcing businesses to close, roads to shut down, and the delivery of products to customers to come to a standstill. An unexpected result of the frigid weather is the rising price of propane, a gas used to heat a significant number of homes and businesses throughout the northeast. The United States Energy Information Administration reports that the price of propane has risen 31 cents from $3.17 a gallon to $3.48 over the past five weeks. The primary reason for the increase is a propane shortage caused by fierce winter weather that has hampered the fuel's delivery to New England. It is estimated that 75 to 80 percent of the propane used to heat New England homes is delivered to the region by rail. With temperatures so low, rail switches can freeze. Trains stop moving. PHMSA Proposes Tank Amendment

On December 30, 2013, the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued Notice of Proposed Rulemaking, 49 CFR Parts 171, 173, 178, and 180 (HM-241). PHMSA is proposing to amend the Hazardous Materials Regulations applicable to the design, construction, certification, recertification and maintenance of cargo tank motorvehicles, cryogenic portable tanks and multi-unit tank car tanks (ton tanks) in response to petitions for rulemaking from the American Society of Mechanical Engineers (ASME), the National Board of Boiler and Pressure Vessel Inspectors (National Board), and the Pressure Vessel Manufacturers Association (PVMA). Specifically, this NPRM proposes to allow the use of the 2013 edition of the ASME's Boiler and Pressure Vessel Code, Section XII (Section XII) for the design, construction, and certification of cargo tank motor vehicles, cryogenic portable tanks and ton tanks. PHMSA also proposes to authorize the use of the 2013 edition of the National Board of Boiler and Pressure Vessel Inspectors' National Board Inspection Code (NBIC), as it applies to the continuing qualification and maintenance of ASME constructed cargo tank motor vehicles, cryogenic portable tanks, and ton tanks constructed to standards in ASME's Section XII, and existing cargo tank motor vehicles and portable tanks constructed to Section VIII, Division 1. If adopted, these amendments will allow for regulatory flexibility, without compromising safety.

Daniel Cristiano, President of Cristiano Welding Supply Company

Dan CristianoDaniel A. Cristiano, 58, was the president of Cristiano Welding Supply Company in Moosic, Pennsylvania. After earning an electrical degree, Mr. Cristiano joined his parents in the business. A strong proponent of education, he attended several welding schools and continued to learn about the industry, information he brought to his customers. In an interview with Welding & Gases Today in 2012, Mr. Cristiano pointed out the importance of helping customers find solutions. He said, "Customers want answers to questions, and if we don't know it, we must find it for them." He treated his customers as friends and knew many by their first name. Committed to the local community, he sponsored a bowling team and shared his skill as an accomplished drummer with his band. Surviving are his wife Mary, sons Daniel A., Bryan and Brad.
